Terms and Conditions of Use
For PayKut Customer Application
Effective Date: 12/08/2025
Welcome to PayKut, a platform owned and operated by Dynamik Modus LLP. These Terms and Conditions ("Terms") govern your use of the PayKut mobile application (“App”) and any related services offered by PayKut. By accessing or using the App, you agree to be bound by these Terms. If you do not agree, you must stop using the App immediately.
1. About PayKut
PayKut is a discount and marketing platform that connects customers with participating merchants. Purchases are completed offline at the merchant’s physical store. PayKut does not provide product delivery, online ordering, or payment settlement services.
2. Eligibility
You must be at least 18 years old to use the PayKut App.
By using the App, you confirm that you are legally capable of entering into a binding agreement.
3. Account Registration
You may be required to create an account to access certain features.
You are responsible for providing accurate information and maintaining the security of your account credentials.
PayKut is not responsible for unauthorized access to your account.
4. Communication Consent and Notifications
By using the App, you consent to receive transactional notifications, promotional updates, and service-related messages from PayKut via SMS, email, app notifications, and WhatsApp. You may opt out of promotional messages at any time, but transactional and service-related communications are necessary for using the platform.
5. Discounts and Offers
Discounts displayed in the App are offered by participating merchants through PayKut and may vary by category, merchant, or location.
Certain categories or shops may not provide discounts on MRP-priced products (e.g., pharmacy items, restaurant menus, regulated goods).
Discount availability is subject to merchant participation and can change without prior notice.
PayKut does not guarantee the availability of any specific offer at the time of your visit to the merchant.
6. Platform Fee
PayKut may charge a platform fee for using the service, which will be clearly displayed in the App before confirmation.
The platform fee amount is determined solely by PayKut and may vary based on the category of shop, merchant location, or other factors.
The platform fee is non-refundable under all circumstances.
7. Purchases and Payments
All purchases are completed directly between you (the customer) and the merchant at the merchant’s store.
Payment methods (cash, UPI, card, etc.) are decided between you and the merchant.
PayKut does not hold or process your payment for in-store purchases.
8. Refund and Cancellation Policy
8.1 Cancellations
As PayKut is a platform that only facilitates discounts and offers for offline in-store purchases, there is no online order or delivery system linked to the App.
Cancellations through the PayKut App are not applicable, as the transaction is completed directly between you (the customer) and the merchant at the merchant’s physical store.
If you wish to cancel a purchase, you must do so before completing payment at the merchant’s store and in accordance with the merchant’s own in-store policy.
PayKut does not mediate or intervene in cancellations once the purchase has been completed at the store.
8.2 Refunds
Any refund requests must be made directly to the merchant from whom the purchase was made.
If a refund is agreed upon between you and the merchant, the merchant will process it at the store itself using cash, UPI, card reversal, or any other mutually agreed payment method.
PayKut will not issue refunds for products or services purchased through merchants, as PayKut is not a seller and does not hold customer payments for offline purchases.
The PayKut platform fee is strictly non-refundable, regardless of:
The reason for cancellation or refund.
Any dispute between customer and merchant.
Any dissatisfaction with the product or service purchased.
8.3 Disputes and Merchant Responsibility
PayKut is not responsible for product quality, merchant behavior, refund timelines, or any other after-sales matters.
If a merchant fails to honor a refund agreement, you must address the matter directly with the merchant, as PayKut cannot compel a merchant to issue a refund.
Customers are advised to check the merchant’s refund and return policy before making a purchase.
8.4 Non-Refundable Scenarios
No refund will be issued by PayKut in the following cases:
You change your mind after making a purchase at the store.
You purchased a product/service that falls under the merchant’s non-refundable category.
The merchant declines to refund as per their own policy.
You are dissatisfied with a discount amount or the merchant’s pricing after the transaction.
You purchased products on which discounts are not applicable (e.g., MRP-priced items in pharmacy, regulated goods, or restaurant menu items excluded from offers).
9. Merchant Information and Responsibilities
Merchants are solely responsible for the quality, pricing, and availability of their products or services.
PayKut is not liable for any disputes, defective products, or service issues.
Any issues should be resolved directly with the merchant.
10. Prohibited Activities
You agree not to:
Misuse discount offers or attempt fraudulent transactions.
Use the App for unlawful purposes.
Interfere with the functioning of the App or engage in activities that harm PayKut or its merchants.
11. Limitation of Liability
PayKut, its owners, and affiliates are not responsible for:
The quality or safety of products or services offered by merchants.
Delays, cancellations, or changes in merchant offers.
Any financial loss or damages arising from the use of the App.
12. Changes to Terms
PayKut reserves the right to update or modify these Terms at any time. Changes will be effective once posted in the App. Your continued use of the App after changes are posted will signify your acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts in Delhi.
14. Store-Specific Terms and Descriptions
Certain merchants may have their own specific terms, conditions, or limitations attached to discounts or offers (for example, exclusions on MRP-priced items, category-specific restrictions, minimum purchase values, or validity periods).
These terms will be displayed in the store’s description within the PayKut App.
By availing a discount or making a purchase through the PayKut App, Customers agree that any such merchant-specific terms and descriptions are binding on them in addition to these Terms and Conditions.
PayKut is not responsible for informing customers of changes in a merchant’s policies beyond what is displayed in the App. Customers are advised to check the store description carefully before purchase.
15. Sharing of Contact Information for Queries
By using the PayKut App, customers agree that in the event they raise a query, complaint, or request related to a purchase, discount, or service, PayKut may share your name and phone number with the concerned merchant.
This is done solely for the purpose of enabling the merchant to respond to customer query and provide appropriate support.
Customers contact information will not be shared with merchants for marketing or promotional purposes without their consent.

Welcome to PayKut – a business discovery platform built for local merchants. These Terms and Conditions (“Terms”) govern your registration and use of the PayKut Business Application (“Merchant App”), operated by Dynamik Modus LLP, with its principal office at C-52, Sector-63, Noida – 201307, Uttar Pradesh, India.
By registering or using the PayKut Merchant App, you agree to the Terms outlined below. If you do not agree with any part of these Terms, please refrain from using the app.
1. Acceptance of Terms
By registering or using the PayKut Merchant App, you confirm that you:
Are at least 18 years of age and legally authorized to represent the business being registered.
Have read, understood, and agree to comply with these Terms.
Will use the app in accordance with applicable local, state, and national laws.
Accept the guidelines and platform rules mentioned in the app's FAQs, which form an integral part of these Terms.
2. About the App
PayKut Business Application is designed for merchants to:
Showcase their business, location, and exclusive offers to potential customers.
Get visibility on the PayKut customer app by uploading the shop details and discounts.
Can view basic customer payment-related insights (only for tracking and reference).
Important:
PayKut does not process payments. All payments are made directly by the customer to the merchant via UPI, cash, or bank transfer using payment gateway integrated in the customer application. PayKut has no role in collecting, routing, holding, or refunding payments.
3. Merchant Data Submission and Verification
By registering on the PayKut Business App, you agree to:
Provide complete and accurate business information including:
Phone number and owner name
Business name and address
Valid PAN, GSTIN (if applicable), and bank account details
Upload legally valid and current documents for identity and business verification.
Cooperate with PayKut’s internal verification process, including KYC procedures.
Failure to provide accurate or genuine information will lead to not verified account which is not visible to customers.
4. Data Locking Post Verification
Once your merchant profile is verified and approved, the following data fields will be locked and cannot be modified directly via the app:
Business address
Submitted documents (PAN, GSTIN, bank details, etc.)
Business category or classification

5. Merchant Visibility and Data Usage
You acknowledge and agree that:
Your business name, category, location, and offers will be displayed to customers on the PayKut app and may be used in marketing campaigns.
PayKut may use non-sensitive business data (business name, category, city, and offers) for:
Digital promotions
SMS/Email campaigns
Social media advertisements
In-app banners and discovery sections
PayKut will never publicly display your PAN, bank account, GSTIN, or contact documents.
6. Exclusive Merchant Listings
PayKut typically offers one listing per category in relevant markets to maintain exclusivity.
Merchant selection is based on partnership, category availability, and verification.
This listing does not imply endorsement or quality certification by PayKut.
7. Offers and Discounts
Owners are solely responsible for managing, updating, and honoring any discounts or cashback offers you publish through the platform.
PayKut does not guarantee the availability or enforcement of your offers. Misuse or bait marketing may lead to delisting.
8. Payments and Refunds
All customer payments are made in app but through payment gateway directly at your store.
PayKut is not involved in and not liable for:
Payment failures or delays
Overcharges or undercharges
Refunds or payment disputes
These matters must be handled directly between merchants and the customer.
Merchants be assured any failure of the payment not reflecting in the application will resolved in 24 hours.
Payments made by customers are reflected in real-time within the PayKut Business Application for tracking purposes. However, the actual settlement of funds is processed on a T+1 basis (next business day), subject to banking and payment partner timelines.
9. App Usage Restrictions
You agree not to:
Use the app for illegal, deceptive, or harmful purposes
Provide false business information or fake documents
Reverse-engineer, copy, or tamper with any aspect of the app
Harass or spam customers using app data or systems
Violations may lead to suspension, delisting, or legal action.
10. Intellectual Property
All content, logos, icons, layouts, and brand elements of PayKut are the intellectual property of Dynamik Modus LLP or its licensors.
You may not copy, reproduce, resell, or distribute any part of the platform without prior written consent.
11. Cookies and Tracking
The app may use cookies and analytical tools to enhance your experience.
Required cookies support the platform’s core functions and cannot be disabled.
You can manage optional cookies through your device settings.
Use of the app indicates consent to our cookie usage as outlined.
12. Comments and Feedback
If you post comments or feedback through the app:
You grant PayKut the right to use, display, and promote them in any media.
You represent that the comments are your own and do not violate any rights.
You agree not to post abusive, defamatory, or unlawful content.
PayKut may remove inappropriate or harmful comments at its sole discretion.
13. Communication Consent and Notifications
You agree and authorize PayKut to send you important updates, promotional offers, and service communications via WhatsApp and other communication channels. You may opt out anytime by following the instructions provided in the message.
13. Linking and External References
Certain organizations (e.g., government agencies, search engines, directories) may link to PayKut’s website without prior permission. Others may request permission via email at support@paykut.in.
No use of the PayKut name, logo, or branding is permitted without a trademark license agreement.
14. Termination and Account Suspension
PayKut may suspend or terminate your access without notice if you:
Provide false or misleading information
Violate any provisions of these Terms
Use the app for illegal or unethical activity
You may uninstall or stop using the app at any time. For permanent account closure, will have to login again using credentials and confirm delete account. Paykut may keep some details after account deletion like payments details, expenses, subscription details etc.
15.Customer Notifications
Merchants may use the PayKut platform to send notifications, offers, or updates to their customers.
By agreeing to these Terms, the merchant confirms that all such messages will be appropriate, lawful, and relevant to their business.
Merchants must not send any offensive, misleading, fraudulent, or inappropriate messages through the platform.
PayKut is not liable for any disputes, complaints, losses, or damages arising from the content of messages sent by merchants to customers.
Any violation of this term may result in suspension or termination of the merchant’s access to the PayKut platform.
15. Limitation of Liability
PayKut provides the app and platform on an “as-is” and “as-available” basis.
We make no guarantees about business outcomes, lead generation, or customer traffic.
We are not liable for:
Financial losses, payment failures, or customer fraud
Damages due to app unavailability or technical issues
Indirect or consequential losses
16. Modifications to Terms
We may update these Terms periodically. Major updates will be communicated via in-app notifications or email. Your continued use of the app constitutes acceptance of any updated Terms.
17. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with this agreement shall be subject to the exclusive jurisdiction of the courts in Noida, Uttar Pradesh.
